1. Scope of Agreement
These Terms of Service constitute a legally binding agreement between your organization ("Client", "Participant") and Tukio Adventures ("Company", "we", "us"). By engaging our services, requesting an assessment, or participating in an experiential safari retreat, you agree to abide by these provisions.
2. Booking, Quotations & Payments
- Provisional Quotations: Program fees (e.g., KES 3,500 – KES 25,000+ per participant) remain valid for 14 calendar days from issuance.
- Confirmation Deposit: A minimum commitment deposit of 50% is required to secure park permits, professional facilitators, and venue reservations.
- Final Settlement: The remaining 50% balance must be settled at least 7 business days prior to the commencement of the scheduled event.
- Currencies: Invoices are rendered in Kenya Shillings (KES) or USD for international delegations.
3. Safety, Physical Fitness & Medical Disclosures
Experiential team building and wilderness exploration involve physical activities including hiking, team obstacle navigation, high-energy challenges, and safari game drives.
- Participants must disclose pre-existing medical conditions (e.g., asthma, severe allergies, cardiovascular history) prior to the event.
- All participants must adhere strictly to lead facilitator safety instructions and Kenya Wildlife Service (KWS) conservation rules.
- Tukio Adventures provides certified first-aid personnel on site during all outdoor sessions.
4. Cancellations, Rescheduling & Force Majeure
- Client Rescheduling: Events rescheduled with more than 14 days' written notice may transfer 100% of deposits to an alternate date within 6 months.
- Late Cancellation (Under 7 Days): Due to pre-booked non-refundable venue and logistical fees, cancellations within 7 days of event date forfeit 50% of total fees.
- Force Majeure: Neither party shall be liable for cancellations arising from severe weather acts of nature, impassable road flooding, civil unrest, or statutory government park closures. In such cases, events are rescheduled without forfeiture.
5. Media, Photography & Video Rights
Unless explicitly opted out in writing by the Client prior to the retreat, Tukio Adventures reserves the right to capture high-resolution photographs and video footage of team activities for post-event corporate debrief packages and promotional marketing showcases.
6. Limitation of Liability
While Tukio Adventures takes all reasonable precautions to maintain highest safety protocols, participation in outdoor wilderness challenges carries inherent natural risks. Clients and participants agree that Tukio Adventures and its facilitators are not liable for incidental losses, personal property damage, or delays resulting from wildlife movement or unforeseen road conditions.
7. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the Laws of the Republic of Kenya. Any disputes shall be subject to amicable arbitration in Nairobi, Kenya.
